Justice Chouhan said the rules would create an unviable environment for startups and would have repercussions for investments in the state.

“If we have such regulatory rules, it will create an unviable environment for startup business in the state.


Startup companies like Uber may pull out of business in the state, which will not be good. It will have a negative impact or repercussions on investments,” he said.

Earlier last month, Uber’s Counsel Sajan Poovayya had submitted that since taxi-hailing app Uber is a technology platform that connects drivers with passengers, it cannot be regulated under India’s Motor Vehicles Act, which governs taxis and aggregators in the country.

The hearing in the matter will continue tomorrow. Drivers have also independently filed a petition in court.

“These should not be issued by the marketplace. Thus, a basket level discount/cash back would have to be restricted to the basket/order of each seller and not at a consolidated level,” it said.

“Cashback/money back guarantee offered by a marketplace should be considered tantamount to influencing selling price,” the association added.

It also said that consolidated orders covering multiple sellers should not be permitted.

“Considering that no seller should be having more that 25 percent share on the market place, the marketplace must file monthly disclosure with relevant (Enforcement Directorate) authority, giving details,” it added.

RAI also said that a full seller profile, including tax registration details, contact numbers, PAN numbers should be available on the online platform and accessible to consumer. “Marketplaces be made responsible for vetting the genuineness of sellers listed on the platform and the authenticity of their contact details to protect consumer interest in cases where the products turn our faulty/fraudulent,” it added.

The FBI can use national security letters to compel Internet and telecommunications firms to hand over a wide range of customer data, including web browsing history and records of online purchases.

San Francisco-based Reddit did not respond to a request for comment. The Federal Bureau of Investigation did not respond to a request for comment.

National security letters have been available as a law enforcement tool since the 1970s, but their frequency and breadth expanded dramatically under the USA Patriot Act, which was passed shortly after the Sept. 11, 2001 attacks on the United States by Islamist militants.

The ACLU report comes after the Justice Department withdrew a request for Apple’s assistance in California, saying on Monday it had succeeded in unlocking an iPhone used by one of the shooters involved in a rampage in San Bernardino in December without Apple’s help.

Other cases involving government requests for Apple’s help are still pending.

A variety of Apple and Google products have been targeted by court orders, according to the ACLU report. In one, an Apple iPhone 5 was seized by a man arrested in 2013 for importing methamphetamine from Mexico.

A California court ordered Apple to help the Justice Department bypass the passcode and copy data onto an external hard drive. The order does not specify which operating system was running on the phone.

Government Permits 100 Percent FDI in Online Marketplaces

The government on Tuesday permitted 100 percent FDI in the marketplace format of e-commerce retailing with a view to attract more foreign investments.

As per the guidelines issued by the Department of Industrial Policy and Promotion (DIPP) on FDI in e-commerce, foreign direct investment (FDI) has not been allowed in inventory-based model of e-commerce.

At present, global online retailer giants like Amazon and ebay are operating online marketplaces in India while home-grown players like Flipkart and Snapdeal have foreign investments even as there were no clear FDI guidelines on various online retail models.

To bring clarity, DIPP has also come out with the definition of ‘e-commerce’, ‘inventory-based model’ and ‘marketplace model’.

Marketplace model of e-commerce means providing of an IT platform by an e-commerce entity on a digital and electronic network to act as a facilitator between buyer and seller.

The inventory-based model of e-commerce means an e-commerce activity where inventory of goods and services is owned by e-commerce entity and is sold to consumers directly, according to the guidelines.

A marketplace entity will be permitted to enter into transactions with sellers registered on its platform on business-to-business basis, DIPP said.

It said that an e-commerce firm, however, will not be permitted to sell more than 25 percent of the sales affected through its marketplace from one vendor or their group companies.

“In order to provide clarity to the extant policy, guidelines for FDI on e-commerce sector have been formulated,” DIPP said.

The government has already allowed 100 percent FDI in business-to-business (B2B) e-commerce.

As per the guidelines, e-commerce means buying and selling of goods and services, including digital products over digital and electronic network.

Digital and electronic network will include computers, TV channels and other Internet application used in automated manner such as web pages, extranets and mobiles.

DIPP said that e-commerce marketplace may provide support services to sellers in respect of warehousing, logistics, order fulfilment, call centre, payment collection and other services.

However, such entities will not exercise ownership over the inventory. “Such an ownership over the inventory will render the business into inventory based model.”

Supreme Court Gives Government More Time to Curb Child Pornography Sites

The Supreme Court on Monday gave the government more time to suggest ways and means for blocking child pornography in its all forms as it was told that due to Holi holidays, the required meeting of officials with National Commission for Women (NCW) could not take place.

Granting two weeks’ time as Additional Solicitor General Pinki Anand said the meeting of the officials with NCW has yet to take place, a bench of Justice Dipak Misra and Justice Shiva Kirti Singh asked the government to address the submission by the petitioner Kamlesh Vaswani that government, after passing an order blocking 450 child porn websites in 2014, revoked it later.

Asking the government to suggest the ways to curb child pornography, the apex court on last hearing on February 26 had said it could, if it wanted, seek suggestions from the National Commission for Women and “we are sure the said Commission would give its suggestions to the Union of India”.

The court had also said that “the innocent children cannot be made prey to these kind of painful situations, and a nation, by no means, can afford to carry any kind of experiment with its children in the name of liberty and freedom of expression”.

“Watching pornography or compelling watching pornography can’t come with the freedom of expression, speech and thought,” it said, asking Anand to “file an appropriate affidavit of the competent authority to suggest the ways and means so that these activities are curbed”.

Expressing its difficulty in dealing with the issue of clamp down on websites carrying child pornography, the government had told the court on February 26 that “as far as the child pornography is concerned, exercise has been undertaken and the central government shall come with the scheme so that appropriate directions in that regard can be issued”.
